An Act to require parental notice of a social and emotional learning questionnaire regarding a student.
Be it enacted by the Legislature of the State of South Dakota:
Section 1. That a NEW SECTION be added:
13-32-3.1. Social and emotional learning--Questionnaire--Parental notice.
Before an employee or contractor of a school district completes a questionnaire or similar document that in whole or in part addresses the social and emotional functioning, learning, or behaviors of a student, or which pertains in whole or in part to the student's mental health, the student's custodial parent must be provided with a blank copy of the questionnaire.
The questionnaire may not be completed and made a part of the student's educational record until the custodial parent has signed and returned a form authorizing the completion of the specifically identified questionnaire.
At the time the questionnaire is completed and made a part of the student's educational record, a copy of the completed questionnaire must be provided to the student's custodial parent.
This section does not apply to a questionnaire or similar document applicable to a student who is receiving special education and related services or services under section 504 of the Rehabilitation Act of 1973.
