SDLRC - 2020 House Bill 1106 - SD Legislature authorize the state investment officer to include an indemnity provision in certain investment-related documents.

ENTITLED An Act to authorize the state investment officer to include an indemnity provision in certain investment-related documents.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

4-5-29.3. Indemnity provision--Authorization.

Notwithstanding the provisions of    3-21-13, the state investment officer may include an indemnity provision in any contract, agreement, or court document related to an investment that involves custody, management, purchase, sale, exchange, or research if the state investment officer determines the inclusion of the indemnity provision is prudent under the circumstances.
