An Act to revise provisions regarding the issuance of certain military specialty plates.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That   32-5-159 be AMENDED:

32-5-159. Military specialty plates--Noncommercial registration and licensing fees.

In addition to the noncommercial annual registration and plate fees, each person receiving military specialty plates shall pay an additional ten dollar fee for the initial issuance of the military specialty plates. All fees collected under this section shall be placed in the license plate special revenue fund. Any owner applying for a military specialty plate listed in    32-5-155 shall pay the noncommercial registration and license fees for the motor vehicle.

Section 2. That   32-5-160 be AMENDED:

32-5-160. Military specialty plates--Fees--Exemption.

Notwithstanding    32-5-159 or any other contrary provisions of      32-5-154 to 32-5-166, inclusive, each veteran receiving the disabled veteran, Prisoner of War, Pearl Harbor survivor, or Purple Heart military specialty plates shall pay a ten dollar fee for the initial issuance of the military specialty plate and an annual fee of ten dollars for renewal decals, but is not subject to the annual registration fees assessed pursuant to    32-5-6 or 32-5-9, unless    32-5-160.2 applies.

Notwithstanding    32-5-159 or any other contrary provisions of      32-5-154 to 32-5-166, inclusive, each veteran receiving the Medal of Honor plate may not be assessed annual registration fees, pursuant to    32-5-6 or 32-5-9, or any other fees associated with the military specialty plate or renewal decals, unless    32-5-160.2 applies.

Each veteran receiving a disabled veteran, Prisoner of War, Pearl Harbor survivor, Purple Heart, or Medal of Honor military specialty plate may get a maximum of two sets of the applied for military specialty plate. The plates may be placed on any automobile, pickup truck, or van licensed pursuant to    32-5-6 or a motorcycle licensed pursuant to    32-5-9. The veteran may choose to place one of the two sets of military specialty plates on a noncommercial pickup truck, which weighs more than six thousand pounds, licensed pursuant to    32-5-6.3, or a motor home licensed pursuant to    32-5-6.1, but shall pay the regular annual registration fees pursuant to those sections.

Notwithstanding    32-5-159, 32-5-160.1, or 32-5-160.2, an applicant for a tribal veteran plate shall pay a fee in accordance with    32-5-124, with the fee distributed pursuant to    32-5-124.

Section 3. That a NEW SECTION be added:

32-5-160.1. Military specialty plates--Issuance--Placement--Limitations.

Any owner applying for a military specialty plate listed in    32-5-155 may receive up to two sets of military specialty plates without payment of a military specialty plate fee. Disabled veteran, Prisoner of War, Pearl Harbor survivor, Purple Heart, and Medal of Honor plates may be placed on any automobile, pickup truck, or van licensed pursuant to    32-5-6 or a motorcycle licensed pursuant to    32-5-9. Any veteran applying for the disabled veteran, Prisoner of War, Pearl Harbor survivor, Purple Heart, or Medal of Honor military specialty plates may place one of the two sets of military specialty plates on a noncommercial pickup truck that weighs more than six thousand pounds licensed pursuant to    32-5-6.3, or a motor home licensed pursuant to    32-5-6.1, but shall pay the regular annual registration fees applicable to the noncommercial pickup truck or motor home.

Section 4. That a NEW SECTION be added:

32-5-160.2. Military specialty plates--Additional sets--Fees.

Any owner may apply for additional sets of military specialty plates in excess of the maximum limit established in    32-5-160.1. For each additional set in excess of the maximum, the owner shall pay a military specialty plate fee of ten dollars for the initial issuance of the plate and all annual noncommercial registration and license fees for the motor vehicle. The military specialty plate fee shall be deposited in the license plate special revenue fund.

Section 5. This Act is effective on January 1, 2021.
