This bill, titled "Custody of domestic companion animals -- Pets," would amend Chapter 15-5 of the General Laws entitled "Divorce and Separation" to create a custody procedure for pets in divorce and separation proceedings. The court would consider various factors in determining sole possession or ownership of the animal, including who owned the animal first, who assumed most responsibility for the animal's needs, and what living arrangement is in the best interest of the animal. The court would also consider factors in awarding joint possession of the animal, such as how long the animal will stay with each party and how veterinary visits and costs will be handled. The bill would not apply to assistance animals. This act would take effect upon passage.
