This bill amends Section 9-20-4 of the General Laws to add the doctrine of assumption of risk to the current comparative negligence statute. It states that in actions brought for personal injuries, injury to property, or death resulting from personal injuries, the fact that the injured person may have assumed the risk of injury and/or death shall not bar a recovery. However, damages will be diminished in proportion to the amount of negligence attributable to the injured person, property owner, or person having control over the property. The bill will take effect upon passage.
