This bill amends the penalties for prohibited acts related to controlled substances. It increases the penalties for manufacturing, delivering, or possessing with intent to manufacture or deliver a controlled substance, as well as for creating, delivering, or possessing with intent to deliver a counterfeit substance. The bill also increases the penalties for knowingly or intentionally possessing a controlled substance without a valid prescription or order from a practitioner.

In addition, the bill modifies the penalties for possession of certain amounts of controlled substances. It reclassifies simple possession of 28 grams or less of certain controlled substances as a misdemeanor, and requires that persons with previous convictions of possession of 28 grams or less have their record modified to reflect a misdemeanor conviction. The bill also creates reporting requirements related to the racial demographics of parties convicted of controlled substance offenses.
