RELATING TO TOWNS AND CITIES -- LOW AND MODERATE INCOME HOUSING

It is enacted by the General Assembly as follows:
1 SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income
2 Housing" is hereby amended by adding thereto the following section:
3 45-53-16. Public transportation requirement.
4 (a) Any municipality not provided with public transportation sufficient to extend to urban
5 service boundaries within the municipality shall be permitted to reduce the percentage of low- or
6 moderate-income housing required pursuant to this chapter from ten percent (10%) of the year
7 round housing units reported in the census to six percent (6%) of the year round housing units
8 reported in the census as defined in ยง 45-53-3(4).
9 (b) The decision to issue the percentage reduction provided in this section shall be
10 determined by the approved monitoring agent.
11 SECTION 2. This act shall take effect upon passage.

1 This act would allow municipalities without public transportation extending to urban
2 service boundaries to reduce the low- or moderate-income housing requirements from ten percent
3 (10%) to six percent (6%).
4 This act would take effect upon passage.
