This bill amends the Child Support Intercept Act to expand the interception of insurance payments to include life insurance proceeds payable to non-custodial parents who are beneficiaries of the policy. Currently, insurers are required to review information provided by the Department of Human Services to determine if a claimant owes past-due child support. If the claimant does owe past-due support, the insurer must withhold the amount of past-due support from the payment and pay it to the family court. The remaining balance is then paid to the claimant. This bill would add life insurance proceeds to the types of payments subject to interception for past-due child support. The bill also allows claimants who are aggrieved by the interception to seek judicial review in the family court. This bill would take effect upon passage.
