This bill, titled the "Fair Limitation on Rental Application Fees Act," seeks to amend the Residential Landlord and Tenant Act by adding a new section. The new section would prohibit landlords, lessors, sub-lessors, real estate brokers, property management companies, or their designees from requiring or demanding prospective tenants to pay for a rental application fee. However, it does not prohibit them from requiring an official state criminal background check or credit check, as long as certain limitations are met. If a prospective tenant provides a required background check or credit report issued within 90 days of the application, no fee may be charged. If the tenant does not provide the required documents, the landlord or designee may charge a fee representing the actual cost of obtaining the background check or credit report. The act would take effect on January 1, 2024.
