This bill amends Section 45-24-73 of the General Laws to require consistent treatment of accessory dwelling units (ADUs) statewide. It prohibits municipalities from imposing excessive restrictions on ADUs, such as restricting tenants based on familial relationship or age, charging unreasonable application fees, requiring infrastructure improvements, discriminating against protected populations, imposing unreasonable dimensional requirements, requiring larger minimum lot sizes, or requiring additional parking spaces. The bill also allows municipalities to permit ADUs in preexisting non-conforming structures through a special use permit, voids private restrictions on ADUs that conflict with the law, and prohibits ADUs from being offered or rented for tourist or transient use or through hosting platforms. Violations of this provision may result in fines of up to $500 per day. The bill would take effect upon passage.
