This bill seeks to amend the General Laws in Chapter 6-45 entitled "Consumer Enforcement of Assistive Technology Device Warranties." The amendment includes several changes to the current law. Firstly, it defines a "reasonable number of attempts to repair" an assistive technology device with a nonconformity. It states that if the same nonconformity is subject to repair two or more times during a specific term, or if the device is out-of-service for a total of 30 or more calendar days during a specific term due to nonconformities, it would be considered a reasonable number of repair attempts.

The amendment also requires the manufacturer/vendor to keep written records of all repair attempts made, including the date of repair request, type of repair requested, length of time required for repair, results of the repair attempt, and the total number of repair attempts made. Additionally, the amendment requires the manufacturer to provide a statement to the consumer at the time of purchase or lease, informing them of their rights under the law. The statement must be written in a specific format and must include information about the consumer's entitlement to a replacement or refund if the device is still defective after two repair attempts or out of service for 30 days within the first year. It also states that if the device is out-of-service for more than seven days or not having a device would be a threat to the consumer's safety, the manufacturer/vendor must provide a loaner device.
