AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, in fees, further providing for annual hauling
3 permits; and, in size, weight and load, further providing for
4 conditions of permits and security for damages and providing
5 for permit for movement of commercial implements of husbandry
6 and farm equipment.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 1943 of Title 75 of the Pennsylvania
10 Consolidated Statutes is amended by adding a subsection to read:
11 § 1943. Annual hauling permits.

13 (q.3) Movement of commercial implements of husbandry and
14 farm equipment.--The annual permit for movement of commercial
15 implements of husbandry and farm equipment as provided in
16 section 4976.3 (relating to permit for movement of commercial
17 implements of husbandry and farm equipment) shall be $450.

19 Section 2. Section 4962(f) and (f.6) of Title 75 are amended
1 to read:
2 § 4962. Conditions of permits and security for damages.

4 (f) When loads permitted.--Only vehicles and combinations
5 permitted or transporting vehicles permitted for movement under
6 the following provisions shall be authorized to carry or haul
7 loads while operating under the permit:
8 Section 4961(a)(2), (3) and (6) (relating to authority to
9 issue permits).
10 Section 4965 (relating to single permits for multiple
11 highway crossings).
12 Section 4968 (relating to permit for movement during
13 course of manufacture).
14 Section 4974 (relating to permit for movement of
15 containerized cargo).
16 Section 4975 (relating to permit for movement of special
17 mobile equipment).
18 Section 4976 (relating to permit for movement of domestic
19 animal feed and whole or unprocessed grain).
20 Section 4976.1 (relating to permit for movement of live
21 domestic animals).
22 Section 4976.2 (relating to permit for movement of eggs).
23 Section 4976.3 (relating to permit for movement of
24 commercial implements of husbandry and farm equipment).
25 Section 4977 (relating to permit for movement of wooden
26 structures).
27 Section 4978 (relating to permit for movement of building
28 structural components).
29 Section 4979 (relating to permit for movement of
30 particleboard or fiberboard used in the manufacture of ready-

2 Section 4979.1 (relating to permit for movement of bulk
3 refined oil).

8 uses).

11 Section 4979.5 (relating to permit for movement of
12 nonhazardous liquid glue).

14 tires).

16 (f.6) One certified escort vehicle.--
17 (1) [A] Except as provided in section 4976.3, a super
18 load, as defined in section 3108(c) (relating to drivers of
19 certified escort vehicles), shall be required to maintain one
20 certified escort vehicle under section 4573(b) (relating to
21 identification of certain vehicles) unless otherwise
22 determined under section 4901(c) that an additional certified
23 escort vehicle or a Pennsylvania State Police escort is
24 necessary.
25 (2) The requirements of this subsection are in addition
26 to, not in lieu of, all other pilot car requirements for the
27 super load movement.

29 Section 3. Title 75 is amended by adding a section to read:
30 § 4976.3. Permit for movement of commercial implements of

1 husbandry and farm equipment.
2 (a) Authorization.--An annual permit may be issued for the
3 movement or operation on highways of commercial implements of
4 husbandry or farm equipment that exceed the maximum width
5 specified in Subchapter B (relating to width, height and length)
6 and maximum vehicle gross weight specified in Subchapter C
7 (relating to maximum weights of vehicles), subject to the
8 following conditions:
9 (1) The overall gross weight of the commercial implement
10 of husbandry or farm equipment or the vehicle or combination
11 transporting the commercial implement of husbandry or farm
12 equipment may not exceed 95,000 pounds.
13 (2) The weight on any nonsteering axle of the commercial
14 implement of husbandry or farm equipment or the vehicle or
15 combination transporting the commercial implement of
16 husbandry or farm equipment may not exceed 21,000 pounds.
17 (3) The overall width of the commercial implement of
18 husbandry or farm equipment or the vehicle or combination
19 transporting the commercial implement of husbandry or farm
20 equipment, including load, may not exceed 21 feet.
21 (4) The movement of the commercial implement of
22 husbandry or farm equipment may only occur between sunrise
23 and sunset.
24 (5) For movement of a commercial implement of husbandry
25 or farm equipment greater than 16 feet in width:
26 (i) The vehicle shall be illuminated with additional
27 lighting on all sides as to be visible from 1,000 feet in
28 all directions.
29 (ii) The vehicle shall be accompanied with a pilot
30 car escort that is equipped with lighting and operated in

1 accordance with regulations promulgated by the
2 department.
3 (6) The maximum travel distance may not exceed 50 miles
4 from the place of origin as shown on the permit.
5 (b) Movement on interstate highways prohibited.--No permit
6 may be issued that would authorize the movement or operation of
7 commercial implements of husbandry or farm equipment on an
8 interstate highway.
9 (c) Construction.--This section shall not be construed to
10 require accompaniment by a certified escort vehicle or operation
11 of pilot car escort by a certified escort vehicle driver as a
12 condition for authorized movement or operation of a vehicle
13 permitted under this section.
14 Section 4. This act shall take effect in 60 days.
