AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, in rules of evidence,
3 further providing for limit on charges.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 6152.1(a) of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended by adding a paragraph to read:
8 § 6152.1. Limit on charges.
9 (a) Charges.--

11 (3) Notwithstanding any other provision of law to the
12 contrary, a health care provider or facility shall provide
13 without charge one complete copy of a patient's medical
14 charts and records if all of the following apply:
15 (i) The patient is a veteran, as defined in 51
16 Pa.C.S. § 7202 (relating to definitions), and is indigent
17 and homeless.
 1 (ii) The medical charts and records are being
2 requested by the patient or a person presenting a valid
3 authorization for the release of the medical charts and
4 records that is signed by the patient or the patient's
5 legally authorized representative.
6 (iii) The medical charts and records are being
7 sought for the purpose of supporting a claim for Federal
8 veterans' disability benefits.

10 Section 2. This act shall take effect in 60 days.
