AN ACT
1 Prohibiting the mandatory COVID-19 vaccination of Pennsylvania <--
2 residents by the Commonwealth, political subdivisions or as a
3 condition of employment.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Short title.
7 This act shall be known and may be cited as the Medical
8 Freedom Act.
9 Section 2. Scope.
10 This act relates to limitations on COVID-19 vaccine <--
11 requirements.
12 Section 3. Findings and declarations.
13 The General Assembly finds and declares:
14 (1) Every resident in this Commonwealth has the
15 inalienable right to bodily integrity and should be free from
16 any threat or compulsion that the individual must receive a
17 COVID-19 vaccination. <--
18 (2) An individual who exercises the right not to be <--
1 vaccinated RECEIVE A COVID-19 VACCINE must not be denied any <--
2 right or privilege of citizenship.
3 (3) Currently this Commonwealth allows for medical and
4 religious exemptions for immunizations and these rights
5 should be given to all Pennsylvania residents who do not want
6 to receive an immunization A COVID-19 VACCINE. <--
7 Section 4. Prohibition.
8 The following apply:
9 (1) The Commonwealth or a political subdivision of the
10 Commonwealth, or an agent thereof, may not mandate an
11 individual in this Commonwealth to receive a COVID-19 <--
12 vaccination.
13 (2) A State agency or political subdivision may not
14 enact or issue a rule, ordinance, order or any similar policy
15 that would result in an individual being required to submit
16 to a COVID-19 vaccination. <--
17 (3) A State agency or political subdivision, or an agent
18 thereof, may not take an action which would result in an
19 individual being required to submit to a COVID-19 <--
20 vaccination, including as a condition of employment, access
21 to education, the ability to travel, entry to a public place
22 or contracting with a State agency or political subdivision.
23 (4) A COVID-19 vaccination offered by the Commonwealth <--
24 as part of a mass vaccination effort may only be provided to
25 individuals who consent to receiving the vaccination, without
26 coercion, after receiving full information of all known
27 ingredients, risks and benefits prior to the COVID-19 <--
28 vaccination.
29 (5) Employers are prohibited from taking any adverse
30 employment action against an individual who declines TO <--

1 RECEIVE a COVID-19 vaccination, including, but not limited <--
2 to, termination, suspension, involuntary reassignment, unpaid
3 leave, demotion, harassment or coercion. If an employer
4 violates the provisions of this paragraph, an aggrieved
5 employee shall have the right TO apply for and receive <--
6 unemployment benefits.
7 (6) An individual may not be discriminated against,
8 denied entrance, service, the ability to purchase goods or
9 receive medical care or to participate for refusal to accept
10 a COVID-19 vaccination. <--
11 (7) A citizen may not be forced or coerced to sign a
12 COVID-19 vaccination declination waiver that is condemning, <--
13 self-incriminating or does not properly express the citizen's
14 beliefs.
15 Section 5. Notice.
16 If the Commonwealth or a political subdivision, or an agent
17 thereof, recommends an individual receive a COVID-19 <--
18 vaccination, the official or entity shall provide notice that
19 the recommendation is not mandatory in each oral or written
20 statement made.
21 Section 6. Effective date.
22 This act shall take effect immediately.
