7 An Act relating to schools; amending 70 O.S. 2021,
7 Section 1210.229-1, which relates to the Oklahoma
8 Alcohol and Drug Abuse Prevention and Life Skills
8 Education Act; expanding applicability of act;
9 requiring certain instruction on fentanyl abuse
9 prevention and drug poisoning awareness; prescribing
10 frequency of and grades for instruction; listing
10 information to be included in fentanyl abuse
11 instruction; authorizing organizations and persons to
11 provide instruction; directing Governor to designate
12 Fentanyl Poisoning Awareness Week in schools;
12 providing for certain instruction during designated
13 week; repealing 70 O.S. 2021, Section 11-103.3, which
13 relates to acquired immune deficiency syndrome (AIDS)
14 prevention education; providing for codification;
14 providing an effective date; and declaring an
15 emergency.

18 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

19 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.229-1,
19
20 is amended to read as follows:
20
21 Section 1210.229-1 Sections 1210.229-1 through 1210.229-5 of
21
22 this title and Section 2 of this act shall be known and may be cited
22
23 as the "Oklahoma Alcohol and Drug Abuse Prevention and Life Skills
23
24 Education Act".

1 SECTION 2. NEW LAW A new section of law to be codified
1
2 in the Oklahoma Statutes as Section 1210.229-8 of Title 70, unless
2
3 there is created a duplication in numbering, reads as follows:
3
4 A. As part of the comprehensive integrated curriculum for
4
5 substance abuse programs provided in Section 1210.229-5 of Title 70
5
6 of the Oklahoma Statutes, each school district shall annually
6
7 provide research-based instruction related to fentanyl abuse
7
8 prevention and drug poisoning awareness to students in grades six
8
9 through twelve.
9
10 B. The instruction required by this section shall include:
10
11 1. Suicide prevention;
11
12 2. Prevention of the abuse of and addiction to fentanyl;
12
13 3. Awareness of local school and community resources and how to
13
14 access those resources; and
14
15 4. Health education that includes information about substance
15
16 use and abuse of fentanyl, including youth substance use and abuse
16
17 of fentanyl.

18 C. The instruction required by this section may be provided by
18
19 an organization or an employee or agent of an organization that is:
19
20 1. A public or private institution of higher education;
20
21 2. A library;
21
22 3. A community service organization;
22
23 4. A religious organization;
23
24 5. A local public health agency; or

1 6. An organization employing mental health professionals.

2 D. To educate students about the dangers posed by fentanyl and
2
3 the risks of fentanyl poisoning, including overdose, the Governor
3
4 shall designate a week to be known as Fentanyl Poisoning Awareness
4
5 Week in public schools. Fentanyl Poisoning Awareness Week may
5
6 include age-appropriate instruction, including instruction on the
6
7 prevention of the abuse of and addiction to fentanyl, as determined
7
8 by each school district.

9 SECTION 3. REPEALER 70 O.S. 2021, Section 11-103.3, is
9
10 hereby repealed.

11 SECTION 4. This act shall become effective July 1, 2024.
11
12 SECTION 5. It being immediately necessary for the preservation
12
13 of the public peace, health or safety, an emergency is hereby
13
14 declared to exist, by reason whereof this act shall take effect and
14
15 be in full force from and after its passage and approval.
