7 An Act relating to state government employees;
amending 74 O.S. 2021, Section 4190, which relates to
8 child care; providing that certain individuals shall
be eligible for Child Care Subsidy program; and
9 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. AMENDATORY 74 O.S. 2021, Section 4190, is
15 amended to read as follows:
16 Section 4190. A. The Director of the Office of Management and
17 Enterprise Services is authorized to approve and administer child
18 care centers for minor dependents of state employees, and may
19 provide consultation to state agencies regarding child care centers.
20 B. The Office of Management and Enterprise Services, the
21 Department of Human Services, and the Oklahoma State Department of
22 Health are directed to assist the Director of the Office of
23 Management and Enterprise Services in the implementation of Sections
24 4190 through 4192 of this title.

1 C. The Director is authorized to promulgate any rules necessary
2 for the establishment and implementation of Sections 4190 through
3 4192 of this title.
4 D. Individuals employed by the State of Oklahoma who have minor
5 dependents shall be eligible for the Child Care Subsidy Program
6 administered by the Department of Human Services.
7 E. Licensed spaces in the child care centers shall be open to
8 all eligible children, including those individuals not employed by
9 the State of Oklahoma and those financially eligible for Department
10 of Human Services child care assistance. However, minor dependents
11 of state employees shall be given highest priority and children
12 financially eligible for Department of Human Services child care
13 assistance second priority for all vacant spaces.
14 E F. The Director shall approve rates for child care consistent
15 with the rates of the industry within the geographic area.
16 SECTION 2. This act shall become effective November 1, 2023.
