7 An Act relating to the Oklahoma Universal Service
7 Fund; creating Oklahoma Universal Service Fund
8 Advisory Board under Corporation Commission;
8 establishing Board purpose; establishing Board
9 membership; directing Board to annually review
9 certain criteria; requiring certain report be
10 submitted to certain public officials by certain
10 date; providing for codification; and providing an
11 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 139.111 of Title 17, unless
15
16 there is created a duplication in numbering, reads as follows:
16
17 A. There is hereby established the Oklahoma Universal Service
17
18 Fund Advisory Board to be administered by the Corporation Commission
18
19 to ensure that the Fund is maintaining current reimbursement
19
20 eligibility criteria based on newly developed and available
20
21 technologies.

22 B. The Board shall consist of seven (7) members. Of the seven
22
23 (7) members:

1 1. One shall be the Director of the Public Utility Division of
1
2 the Commission or his or her designee; and
2
3 2. The remaining six members shall be nongovernmental
3
4 information technology professionals. Of the remaining six members:
4
5 a. two shall be appointed by the Governor,
5
6 b. two shall be appointed by the President Pro Tempore of
6
7 the Senate, and
7
8 c. two shall be appointed by the Speaker of the House of
8
9 Representatives.

10 C. The Board shall, on no less than an annual basis, evaluate
10
11 and review the eligible projects and technology for reimbursement
11
12 from the Fund. The Board shall submit the findings and any
12
13 recommendations for statutory and regulatory updates to the
13
14 Governor, President Pro Tempore of the Senate, and the Speaker of
14
15 the House of Representatives no later than July 1st of a given
15
16 calendar year.

17 SECTION 2. This act shall become effective November 1, 2023.
