7 An Act relating to the Oklahoma Department of
7 Commerce; amending 74 O.S. 2021, Section 5017.1,
8 which relates to federal energy conservation
8 programs; requiring Department to publish and
9 annually update certain information; providing
9 contents of certain published information; and
10 providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 74 O.S. 2021, Section 5017.1, is
13
14 amended to read as follows:
14
15 Section 5017.1. A. The Oklahoma Department of Commerce shall
15
16 have the authority to establish, administer and enforce state and
16
17 federal energy conservation programs including, but not limited to,
17
18 implementing The Energy Conservation Act of 1975 (P.L. 94-163),
18
19 National Energy Extension Service Act (P.L. 95-39, 42 U.S.C. Section
19
20 7001 et seq.) and the National Conservation Policy Act (P.L. 95-
20
21 619), except as otherwise provided by law.

22 B. The Energy Conservation Services Division of the Oklahoma
22
23 Corporation Commission is hereby abolished. All personnel,
23
24 equipment, files, fixtures, funds, furniture, publications and

1 supplies, and all duties, functions, authority and contractual

2 obligations that relate to the Energy Conservation Services Division
2
3 of the Oklahoma Corporation Commission are hereby transferred to and
3
4 vested in the Oklahoma Department of Commerce.

5 C. Employees transferred to the Oklahoma Department of Commerce
5
6 shall be classified and subject to the provisions of the Merit
6
7 System of Personnel Administration as provided for in the Oklahoma
7
8 Personnel Act. The salaries, grade and/or class of the employees
8
9 transferred shall be adjusted to be commensurate with comparable
9
10 positions in the Oklahoma Department of Commerce.

11 D. The full-time-equivalent employee positions funded through
11
12 the federal energy conservation programs outlined in this section
12
13 shall terminate upon the exhaustion of said the federal funding.
13
14 E. The Department shall make publicly available on its website,
14
15 to be updated annually, information related to federal energy
15
16 efficiency incentive programs. The information provided shall
16
17 include, but not be limited to:
17
18 1. Information regarding ongoing programs for individual
18
19 households, multi-family housing, and any other energy efficiency
19
20 programs;
20
21 2. Information related to Oklahoma businesses that are
21
22 promoting and implementing energy efficiency incentive programs; and
22
23 3. Any other information that would promote public awareness
23
24 and adoption of any available energy efficiency program.

1 SECTION 2. This act shall become effective November 1, 2023.
