7 A Joint Resolution directing the Secretary of State
7 to refer to the people for their approval or
8 rejection a proposed amendment to Section 26 of
8 Article II of the Oklahoma Constitution; expanding
9 the rights of citizens to keep and bear arms;
9 updating statutory language; making language gender
10 neutral; providing ballot title; and directing
10 filing.

13 BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE
13
14 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE:

15 SECTION 1. The Secretary of State shall refer to the people for
15
16 their approval or rejection, as and in the manner provided by law,
16
17 the following proposed amendment to Section 26 of Article II of the
17
18 Oklahoma Constitution to read as follows:
18
19 Section 26. A. The fundamental right of a each individual
19
20 citizen to keep and to bear arms in defense of his home, or her
20
21 person, or property, or including handguns, rifles, shotguns,
21
22 knives, nonlethal defensive weapons and other arms in common use, as
22
23 well as ammunition and the components of arms and ammunition, for
23
24 self-defense, lawful hunting and recreation, in aid of the civil

1 power, when thereunto legally lawfully summoned, or for any other
1
2 legitimate purpose shall never be prohibited; but nothing herein
2
3 contained not be infringed.

4 B. This section shall not prevent the Legislature from
4
5 regulating the carrying of weapons enforcing or adopting narrowly
5
6 tailored time, place and manner regulations, or authorizing
6
7 political subdivisions to adopt and enforce such regulations, to
7
8 serve a compelling state interest.
8
9 C. No law shall impose registration or special taxation upon
9
10 the keeping of arms including the acquisition, ownership, possession
10
11 or transfer of arms, ammunition or the components of arms and
11
12 ammunition.

13 SECTION 2. The Ballot Title for the proposed Constitutional
13
14 amendment as set forth in SECTION 1 of this resolution shall be in
14
15 the following form:

18 THE GIST OF THE PROPOSITION IS AS FOLLOWS:

19 This measure would amend Section 26 of Article 2 of the Oklahoma
19
20 Constitution. This measure would prevent infringement of the
20
21 fundamental right of a citizen to keep and bear arms. This
21
22 measure will not prevent the Legislature from adopting
22
23 regulations that serve a narrowly tailored compelling state
23
24 interest. This measure would prohibit the imposition of

1 registration or special taxation upon the keeping of or transfer

2 of arms, ammunition or the components of arms or ammunition.

6 SECTION 3. The President Pro Tempore of the Senate shall,

9 hereof, with the Secretary of State and one copy with the Attorney
9
10 General.
