7 An Act relating to voter registration; amending 26
7 O.S. 2021, Sections 4-120, as amended by Section 3,
8 Chapter 293, O.S.L. 2022, and 4-120.5 (26 O.S. Supp.
8 2022, Section 4-120), which relate to cancellation of
9 registrations; adding cause for cancellation of voter
9 registration; requiring court to prepare certain
10 list; requiring list to be provided to county
10 election board; requiring secretary to cancel certain
11 registrations; requiring report to district attorney
11 and United States attorney; updating statutory
12 language; and providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4-120, as
16
17 amended by Section 3, Chapter 293, O.S.L. 2022 (26 O.S. Supp. 2022,
17
18 Section 4-120), is amended to read as follows:
18
19 Section 4-120. A. The registration of any registered voter
19
20 shall be canceled only for one of the following reasons:
20
21 1. Written notice from the voter pursuant to Section 4-120.1 of
21
22 this title;
22
23 2. Death;
23
24 3. Conviction of a felony;

1 4. Judicial determination of mental incapacitation under Title

2 30 of the Oklahoma Statutes;
2
3 5. Registration in another county or state;
3
4 6. Failure to respond to a confirmation of address mailing and
4
5 failure to vote as prescribed in Section 4-120.2 of this title; or
5
6 7. The surrendering of the voter’s Oklahoma driver license to
6
7 the Department of Public Safety Service Oklahoma upon being issued a
7
8 driver license in another state; or
8
9 8. Being excused from jury duty for not being a citizen of the
9
10 United States.

11 B. For purposes of this section, paragraphs 5 and 7 of
11
12 subsection A of this section shall constitute confirmation from the
12
13 voter to cancel his or her voter registration due to a change of
13
14 residence.
14
15 C. A list of voter registrations that were canceled during the
15
16 previous twenty-four (24) months, and the reason for the
16
17 cancellation, shall be made available to the public.

18 SECTION 2. AMENDATORY 26 O.S. 2021, Section 4-120.5, is
18
19 amended to read as follows:
19
20 Section 4-120.5. A. The court clerk in each county shall
20
21 prepare each month a list of all persons who have been adjudged
21
22 incapacitated and hold said provide the list for to the secretary of
22
23 the county election board. The secretary shall cancel the
23
24 registration of each registered voter included on said the list, and

1 such the person shall be ineligible for registration until he or she

2 has been adjudged no longer incapacitated by a court of competent
2
3 jurisdiction.

4 B. The court clerk in each county shall prepare each month a
4
5 list of all persons who were excused from jury duty for not being a
5
6 citizen of the United States and provide the list to the secretary
6
7 of the county election board. The secretary shall cancel the
7
8 registration of each registered voter included on the list, and
8
9 shall report the person or persons to the district attorney and the
9
10 United States attorney for the county.

11 SECTION 3. This act shall become effective November 1, 2023.
