7 An Act relating to teachers; amending 70 O.S. 2021,
7 Section 6-101.3, which relates to definitions for
8 teachers; modifying certain definition; providing an
8 effective date; and declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. AMENDATORY 70 O.S. 2021, Section 6-101.3, is
12
13 amended to read as follows:
13
14 Section 6-101.3. As used in Section 6-101 et seq. of this
14
15 title:
15
16 1. “Administrator” means a duly certified person who devotes a
16
17 majority of time to service as a superintendent, elementary
17
18 superintendent, principal, supervisor, vice principal, or in any
18
19 other administrative or supervisory capacity in the school district;
19
20 2. “Dismissal” means the discontinuance of the teaching service
20
21 of an administrator or teacher during the term of a written
21
22 contract, as provided by law;
22
23 3. “Nonreemployment” means the nonrenewal of the contract of an
23
24 administrator or teacher upon expiration of the contract;

1 4. “Career teacher” means a teacher who:

2 a. is employed by a school district prior to the 2017-
2
3 2018 school year and has completed three (3) or more
3
4 consecutive complete school years as a teacher in one
4
5 school district under a written continuing or
5
6 temporary teaching contract, or
6
7 b. is employed for the first time by a school district
7
8 under a written continuing or temporary teaching
8
9 contract during the 2017-2018 school year and
9
10 thereafter and:
10
11 (1) has completed three (3) consecutive complete
11
12 school years as a teacher in one or more school
12
13 district districts under a written continuing or
13
14 temporary teaching contract and has achieved a
14
15 district evaluation rating of “superior” as
15
16 measured pursuant to the TLE as set forth in
16
17 Section 6-101.16 of this title for at least two
17
18 (2) of the three (3) school years,
18
19 (2) has completed four (4) consecutive complete
19
20 school years as a teacher in one or more school
20
21 district districts under a written continuing or
21
22 temporary teaching contract, has averaged a
22
23 district evaluation rating of at least
23
24 “effective” as measured pursuant to the TLE for

1 the four-year period, and has received district
1
2 evaluation ratings of at least “effective” for
2
3 the last two (2) years of the four-year period,
3
4 or
4
5 (3) has completed four (4) or more consecutive
5
6 complete school years in one or more school
6
7 district districts under a written continuing or
7
8 temporary teaching contract and has not met the
8
9 requirements of subparagraph a or b of this
9
10 paragraph, only if the principal of the school at
10
11 which the teacher is employed submits a petition
11
12 to the superintendent of the school district
12
13 requesting that the teacher be granted career
13
14 status, the superintendent agrees with the
14
15 petition, and the school district board of
15
16 education approves the petition. The principal
16
17 shall specify in the petition the underlying
17
18 facts supporting the granting of career status to
18
19 the teacher;
19
20 5. “Teacher hearing” means the hearing before a school district
20
21 board of education after a recommendation for dismissal or
21
22 nonreemployment of a teacher has been made but before any final
22
23 action is taken on the recommendation, held for the purpose of
23
24 affording the teacher all rights guaranteed by the United States

1 Constitution and the Constitution of Oklahoma under circumstances

2 and for enabling the board to determine whether to approve or
2
3 disapprove the recommendation;
3
4 6. “Probationary teacher” means a teacher who:
4
5 a. is employed by a school district prior to the 2017-
5
6 2018 school year and has completed fewer than three
6
7 (3) consecutive complete school years as a teacher in
7
8 one school district under a written teaching contract,
8
9 or
9
10 b. is employed for the first time by a school district
10
11 under a written teaching contract during the 2017-2018
11
12 school year and thereafter and has not met the
12
13 requirements for career teacher as provided in
13
14 paragraph 4 of this section;
14
15 7. “Suspension” or “suspended” means the temporary
15
16 discontinuance of the services of an administrator or teacher, as
16
17 provided by law;
17
18 8. “Teacher” means a person defined as a teacher in Section 1-
18
19 116 of this title; and
19
20 9. “District evaluation rating” means the rating issued based
20
21 on the components of the TLE as set forth in subsection B of Section
21
22 6-101.16 of this title.

23 SECTION 2. This act shall become effective July 1, 2023.

1 SECTION 3. It being immediately necessary for the preservation
1
2 of the public peace, health, or safety, an emergency is hereby
2
3 declared to exist, by reason whereof this act shall take effect and
3
4 be in full force from and after its passage and approval.
