7 An Act relating to school district salary schedules;
7 amending 70 O.S. 2021, Section 5-141, which relates
8 to district adoption of minimum salary schedules;
8 requiring the schedules to include certain salary and
9 benefit information; updating statutory references;
9 providing an effective date; and declaring an
10 emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-141, is
14
15 amended to read as follows:
15
16 Section 5-141. A. Each school district of this state shall
16
17 adopt a minimum salary schedule, as provided for in subsection B of
17
18 this section, and shall transmit a copy of it to the State Board of
18
19 Education within thirty (30) days after adoption. A school district
19
20 shall not calculate salaries of teachers solely as a proportion of
20
21 the salaries of the administrators of the district.
21
22 B. The minimum salary schedule adopted and transmitted to the
22
23 State Board of Education pursuant to this section shall include:

1 1. The base salary amounts including the minimum state salary

2 amounts provided for in Section 18-114.14 of this title and district
2
3 increments in excess of the minimums; and
3
4 2. District-paid benefits, such as life, dental, disability,
4
5 salary protection, vision, cancer, and health supplemental
5
6 insurance.
6
7 C. Districts shall be encouraged to provide compensation
7
8 schedules to reflect district policies and circumstances, including
8
9 differential pay for different subject areas and special incentives
9
10 for teachers in districts with specific geographical attributes.
10
11 Districts may also adopt a salary schedule that provides additional
11
12 compensation for achieving certain ratings under the Oklahoma
12
13 Teacher and Leader Effectiveness Evaluation System (TLE) as set
13
14 forth in Section 6 of this act 6-101.16 of this title. Any salary
14
15 schedule adopted by a district pursuant to this section shall not
15
16 set salaries at amounts less than those set pursuant to Section 18-
16
17 114.12 18-114.14 of this title.

18 C. D. The State Department of Education shall compile a report
18
19 of the minimum salary schedules for every school district in the
19
20 state and shall submit the report to the Governor, Speaker of the
20
21 House of Representatives, and President Pro Tempore of the Senate no
21
22 later than December 15 of each year.
22
23 D. E. Each school district shall file within fifteen (15) days
23
24 of signing the contract, the employment contract of the

1 superintendent of the school district with the State Department of
1
2 Education. The Department shall keep all contracts available for
2
3 inspection by the public. The school district shall not be
3
4 authorized to pay any salary, benefits, or other compensation to a
4
5 superintendent which are not specified in the contract on file and
5
6 shall not pay administrators any amounts for accumulated sick leave
6
7 that are not calculated on the same formula used for determining
7
8 payment for accumulated sick leave benefits for other full-time
8
9 employees of that school district and shall not pay administrators
9
10 any amounts for accumulated vacation leave benefits that are not
10
11 calculated on the same formula used for determining payment for
11
12 accumulated vacation leave benefits for other twelve-month full-time
12
13 employees of that school district.

14 E. F. By October 1 of each year each district board of
14
15 education shall prepare a schedule of salaries and fringe benefits
15
16 paid administrators employed by the district, including a
16
17 description of the fringe benefits. The schedule shall be a public
17
18 record and shall be disclosed as required by the Oklahoma Open
18
19 Records Act. The board shall file a copy of the schedule with the
19
20 State Department of Education within one week of completion.
20
21 F. G. For purposes of this section the term “administrator”
21
22 shall include employees who are employed and certified as
22
23 superintendents, assistant superintendents, principals, and
23

1 assistant principals and who have responsibilities for supervising

2 classroom teachers.

3 SECTION 2. This act shall become effective July 1, 2023.
3
4 SECTION 3. It being immediately necessary for the preservation
4
5 of the public peace, health, or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
