7 An Act relating to definitions and general
7 provisions; amending 25 O.S. 2021, Section 82.1,
8 which relates to holidays; authorizing personal
8 holiday leave for state employees; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 25 O.S. 2021, Section 82.1, is
13
14 amended to read as follows:
14
15 Section 82.1. A. The designation and dates of holidays in
15
16 Oklahoma shall be as follows: Each Saturday, Sunday, New Year’s Day
16
17 on the 1st day of January, Martin Luther King, Jr.’s Birthday on the
17
18 third Monday in January, Presidents’ Day on the third Monday in
18
19 February, Memorial Day on the last Monday in May, Independence Day
19
20 on the 4th day of July, Labor Day on the first Monday in September,
20
21 Veterans’ Day on the 11th day of November, Thanksgiving Day on the
21
22 fourth Thursday in November, the day after Thanksgiving Day,
22
23 Christmas on the 25th day of December, the day before or after
23
24 Christmas if Christmas is not on a Saturday or Sunday, the Thursday

1 and Friday before Christmas if Christmas is on a Saturday, the

2 Monday and Tuesday after Christmas, if Christmas is on a Sunday; and
2
3 if any of such holidays other than Christmas fall on Saturday, the
3
4 preceding Friday shall be a holiday in that year and if any of such
4
5 holidays other than Christmas fall on Sunday, the succeeding Monday
5
6 shall be a holiday in that year.

7 B. The Governor shall issue an Executive Order each year
7
8 specifying the dates on which the holidays other than Saturdays and
8
9 Sundays designated in subsection A of this section occur. If the
9
10 President of the United States declares any day other than those
10
11 listed in subsection A of this section as a national holiday, the
11
12 Governor may issue an Executive Order declaring such day a state
12
13 holiday.

14 C. Any act authorized, required, or permitted to be performed
14
15 on a holiday as designated in subsection A of this section may be
15
16 performed on the next succeeding business day, and no liability or
16
17 loss of rights of any kind shall result from such delay.
17
18 D. State employees, except for temporary and other limited term
18
19 employees, shall be entitled to a day off work without loss of pay
19
20 on those holidays specified in an Executive Order issued by the
20
21 Governor pursuant to subsection B of this section. Those state
21
22 employees, except for temporary and other limited term employees,
22
23 who are required to work on a holiday specified in subsection B of
23
24 this section shall be entitled to a day off work, without loss of

1 pay, on an alternative date or payment in lieu thereof at the

2 discretion of the appointing authority and in accordance with rules
2
3 of the Director of the Office of Management and Enterprise Services.

4 E. For the purposes of this section, “holiday” means that
4
5 agencies whose mission does not require them to be open for business
5
6 every day of the year shall be closed for official business.
6
7 F. In addition to the holidays specified in subsection A of
7
8 this section, state employees, except for temporary and other
8
9 limited term employees, shall be entitled to one personal holiday
9
10 each year which may be used on Good Friday, Juneteenth, Statehood
10
11 Day, Indigenous Peoples’ Day, Columbus Day, or the birthday of the
11
12 employee. If any of such holidays fall on Saturday, the preceding
12
13 Friday shall be a holiday in that year, and if any of such holidays
13
14 fall on Sunday, the succeeding Monday shall be a holiday in that
14
15 year.

16 SECTION 2. This act shall become effective November 1, 2023.
