7 An Act relating to schools; providing definitions;
7 prohibiting public schools and charter schools from
8 teaching or training students to believe certain
8 divisive concepts; allowing a teacher to be dismissed
9 or not reemployed for teaching or training students
9 to believe certain divisive concepts; providing
10 certain construction; providing for promulgation of
10 rules; providing for codification; providing an
11 effective date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 11-103.12 of Title 70, unless
16
17 there is created a duplication in numbering, reads as follows:

18 A. As used in this section:
18
19 1. “Divisive concepts” means the concepts that:
19
20 a. one race or sex is inherently superior to another race
20
21 or sex,
21
22 b. the United States is fundamentally racist or sexist,

1 c. an individual, by virtue of his or her race or sex, is

2 inherently racist, sexist or oppressive, whether
2
3 consciously or unconsciously,
3
4 d. an individual should be discriminated against or
4
5 receive adverse treatment solely or partly because of
5
6 his or her race or sex,
6
7 e. members of one race or sex cannot and should not
7
8 attempt to treat others without respect to race or
8
9 sex,
9
10 f. an individual’s moral character is necessarily
10
11 determined by his or her race or sex,
11
12 g. an individual, by virtue of his or her race or sex,
12
13 bears responsibility for actions committed in the past
13
14 by other members of the same race or sex,
14
15 h. any individual should feel discomfort, guilt, anguish
15
16 or any other form of psychological distress on account
16
17 of his or her race or sex,
17
18 i. meritocracy or traits such as a hard work ethic are
18
19 racist or sexist or were created by a particular race
19
20 to oppress another race, or
20
21 j. any other form of race or sex stereotyping or any
21
22 other form of race or sex scapegoating;

1 2. “Race or sex stereotyping” means ascribing character traits,
1
2 values, moral and ethical codes, privileges, status or beliefs to a
2
3 race or sex, or an individual because of his or her race or sex; and
3
4 3. “Race or sex scapegoating” means assigning fault, blame or
4
5 bias to a race or sex or to members of a race or sex because of
5
6 their race or sex. It also includes any claim that consciously or
6
7 unconsciously and by virtue of his or her race or sex, members of
7
8 any race are inherently racist or are inherently inclined to oppress
8
9 others, or that members of a sex are inherently sexist or inclined
9
10 to oppress others.

11 B. Public school districts and public charter schools in this
11
12 state shall be prohibited from teaching, instructing or training any
12
13 student to believe any of the divisive concepts set forth in
13
14 subsection A of this section.
14
15 C. Subject to the provisions of the Teacher Due Process Act of
15
16 1990, a teacher may be dismissed or not reemployed for teaching,
16
17 instructing or training any student to believe any of the divisive
17
18 concepts set forth in subsection A of this section.
18
19 D. Nothing in this section shall be construed to prohibit
19
20 discussing, as part of a larger course of academic instruction, the
20
21 divisive concepts provided for in subsection A of this section in an
21
22 objective manner and without endorsement.

23 E. The State Board of Education may promulgate rules to
23
24 implement and monitor compliance with the provisions of this act.

1 SECTION 2. This act shall become effective July 1, 2021.

2 SECTION 3. It being immediately necessary for the preservation
2
3 of the public peace, health or safety, an emergency is hereby
3
4 declared to exist, by reason whereof this act shall take effect and
4
5 be in full force from and after its passage and approval.
