7 An Act relating to elections; establishing procedures
for voters with a disability to request ballot;
8 providing for ballot and balloting materials to be
sent via electronic transmission; providing for
9 transmission and return of ballot by certain time;
providing for codification; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 14-201 of Title 26, unless there
16 is created a duplication in numbering, reads as follows:
17 A. The Secretary of the State Election Board shall establish
18 procedures to enable a voter with a disability to independently and
19 privately mark a mail ballot or use an electronic voting device that
20 produces a paper record using nonvisual access, low vision access or
21 other assistive technology in order for the voter to vote in a mail
22 ballot election pursuant to Section 14-108 of Title 26 of the
23 Oklahoma Statutes. The procedures shall include an accessible

1 method, to be determined by the Secretary, by which a voter with a
2 disability may request such a ballot.
3 B. Upon receipt of the ballot application by a voter with a
4 disability, the secretary of the county election board shall
5 transmit the ballot and balloting materials to the voter by
6 electronic transmission.
7 C. If a ballot application from a voter with a disability
8 arrives after the jurisdiction begins transmitting ballots and
9 balloting materials to voters, the secretary of the county election
10 board shall transmit the ballot and balloting materials to the voter
11 within seventy-two (72) hours after the receipt of the application.
12 D. A voter with a disability who receives a ballot pursuant to
13 this section shall:
14 1. Return the ballot via electronic transmission to the county
15 election board; or
16 2. Print the ballot and return it to the county election board
17 via United States Postal Service or hand-delivery.
18 Such ballot shall be received by the county election board before
19 the close of polls on the day of the election.
20 SECTION 2. This act shall become effective November 1, 2021.
