7 An Act relating to prevention and control of disease;
7 prohibiting compulsory immunization by state entity
8 or political subdivision; prohibiting penalties;
8 providing for codification; and declaring an

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1-502.5 of Title 63, unless
14
15 there is created a duplication in numbering, reads as follows:

16 Notwithstanding any other provision of law, no state entity or
16
17 political subdivision of this state shall, through direct or
17
18 indirect means, compel or coerce any person under its jurisdiction
18
19 to receive any immunization. No person shall be punished through
19
20 any means including, but not limited to, a monetary fine, for such
20
21 person’s refusal to receive any immunization. As used in this
21
22 section, “political subdivision” means a county, city, town, school
22
23 district or other local governmental or public entity located within
23
24 this state.

1 SECTION 2. It being immediately necessary for the preservation

2 of the public peace, health or safety, an emergency is hereby
2
3 declared to exist, by reason whereof this act shall take effect and
3
4 be in full force from and after its passage and approval.
