7 An Act relating to presidential electors; amending 26
7 O.S. 2011, Section 10-103, which relates to election
8 of presidential electors; modifying time for election
8 of presidential electors; modifying entity to elect
9 presidential electors; establishing contingency for
9 expiration of certain requirements; providing
10 exception upon enactment of certain federal law; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 26 O.S. 2011, Section 10-103, is
14
15 amended to read as follows:
15
16 Section 10-103. A. On the third Tuesday after the first Monday
16
17 in November in each year next preceding the expiration of the term
17
18 of office of each President of the United States, the Legislature of
18
19 this state shall convene pursuant to the provisions of Section 27A
19
20 of Article 5 of the Oklahoma Constitution and shall elect a number
20
21 of electors for President and Vice President equal to the number of
21
22 United States Senators and United States Representatives which the
22
23 state is entitled to elect. If a federal law is enacted pursuant to
23
24 clause 1 of Section 4 of Article 1 of the United States Constitution

1 that requires security measures for elections including, but not

2 limited to, voter identification requirements and the use of
2
3 auditable paper ballots, the provisions of this subsection shall
3
4 cease to be in effect on the effective date of such federal law.

5 B. On Except as provided by subsection A of this section, on
5
6 the first Tuesday after the first Monday in November in each year
6
7 next preceding the expiration of the term of office of each
7
8 President of the United States, the registered voters of this state
8
9 shall elect a number of electors for President and Vice President
9
10 equal to the number of United States Senators and United States
10
11 Representatives which the state is entitled to elect. Said electors
11
12 shall be elected in the same manner as is provided for state
12
13 officers.

14 SECTION 2. It being immediately necessary for the preservation
14
15 of the public peace, health or safety, an emergency is hereby
15
16 declared to exist, by reason whereof this act shall take effect and
16
17 be in full force from and after its passage and approval.
