SUMMARY
 Exempts from the Agricultural Seed Law, the seeds of a native Ohio plant when all of the
following conditions are met:
 The ownership of the seeds is freely transferred;
 The transfer occurs without remuneration; and
 The seeds are used in one of the following ways:
 To support conservation of butterflies or other insects;
 To plant and create native plants habitats; or
 To propagate native plants for their specific conservation.
DETAILED ANALYSIS
Ohio seeds exempted from certain requirements
The bill exempts certain seeds from regulation under the Agricultural Seed Law.
Specifically, it exempts agricultural, vegetable, or flower seeds of a native Ohio plant whose
ownership is freely transferred, without remuneration of any sort, when used in one of the
following ways:
1. To support conservation of butterflies or other insects;
2. To plant and create native plants habitats; or
3. To propagate native plants for their specific conservation.1

Generally, under current law, a person who is selling or distributing agricultural,
vegetable, or flowers seeds that are not exempt from regulation must adhere to various
container label requirements, such as displaying on the label:
1. The commonly accepted name of the kind or variety of each agricultural seed
component in excess of 5% by weight of the whole and the percentage by weight of
each in the order of its predominance;
2. The lot number; and
3. Certain percentages by weight of various types of seeds included in the container.2
Ohio law prohibits a person who is not exempt from the laws governing agricultural
seeds from altering a label or mislabeling a container, disseminating any false or misleading
claim or advertisement concerning the quality or performance characteristic of any seed, or
making a false advertising claim regarding the seeds for sale.3
