This bill establishes regulations regarding the use of social care information within a Closed-Loop Referral System (CLRS). It defines key terms such as "Closed-Loop Referral System," "participating organization," "social care," and "social care information," outlining the roles of various entities involved in the sharing and management of social care data. The bill emphasizes that social care information pertains to the needs and services related to an individual's social requirements, including food stability, housing, and education.
Furthermore, the bill prohibits participating organizations from selling or licensing social care information stored in or transmitted through a CLRS, and restricts the use of such information solely to the purposes for which it was collected. Violations of these provisions will result in a civil penalty of $1,000 for each infraction, which will be enforced by the Division of Consumer Affairs. The Director of the Division is tasked with adopting necessary rules and regulations for the implementation of the act, which will take effect 180 days after enactment.
