This bill establishes the Office of Film and Creative Media within the Department of Business and Economic Affairs, which will be overseen by a classified director. The office's primary functions include connecting film and media industry organizations in New Hampshire, acting as a liaison for production companies, providing information on tax incentives, and maintaining databases of industry professionals and opportunities. The office is also empowered to pursue federal grants and private partnerships to bolster its initiatives. To support the establishment and operation of this office, the bill appropriates $500,000 for each of the fiscal years ending June 30, 2026, and June 30, 2027.
Additionally, the bill introduces two Business Enterprise Tax (BET) credits for qualifying film and motion picture production companies: a 25% tax credit on qualifying employee wages and a 25% tax credit on production-related expenses, with specific eligibility criteria. The payroll tax credit is available to production companies that incur at least $50,000 in production-related expenses, allowing them to claim a credit equal to 25% of qualifying payments made to employees, capped at $250,000 per employee. The production tax credit is accessible to companies that spend at least 50% of their filming time and production expenses in New Hampshire. Both credits are non-refundable, non-transferable, and cannot offset Business Profits Tax (BPT) liability, with no specified annual or total program cap. The act will take effect 60 days after its passage.
