This bill amends existing law regarding the payment of wages to salaried employees in the event of termination of employment. Specifically, it allows employers to prorate an employee's salary on a daily basis under three conditions: if the employee is hired after the beginning of a pay period, if the employee resigns before the end of a pay period, or if the employee is terminated for cause by the employer. The bill introduces new language to clarify that an employee who gives notice of their intention to end employment within the next 14 days is considered to have resigned of their own accord. This applies even if the employer decides to maintain the employment relationship until the employee's specified termination date.

The bill includes insertions that modify the existing law by adding gender-neutral language ("his or her") and by defining the conditions under which an employee is considered to have voluntarily terminated their employment. The bill stipulates that an employee who notifies their employer of their intent to resign at a future date within the following 14 days will be treated as having resigned voluntarily, regardless of the employer's actions following the notice. The act is set to take effect on January 1, 2024.
