This bill provides a procedure for individuals to obtain a new birth certificate that reflects a gender designation other than the one assigned at birth. The bill states that if an individual requests a birth record with a different gender designation, a new birth record will be prepared upon receipt of a notarized certification by a licensed and qualified healthcare provider affirming the individual's gender designation. The application for the change of gender must be signed by the applicant and, if applicable, by each parent listed on the birth certificate or the minor's legal guardian. The individual must surrender any prior birth record issued by the state of New Hampshire. The fee to amend a birth record for gender designation will be the same as the fee to amend a birth record for other purposes. Any subsequent amendment to the birth record regarding gender designation will require a court order. The bill also defines "licensed and qualified healthcare provider" as a treating and licensed physician, physician assistant, psychologist, advanced practice registered nurse, clinical social worker, or clinical mental health counselor. The Secretary of State will provide an application for statewide use to implement this procedure. The bill will take effect on January 1, 2024.

The Department of State estimates that there will be an expenditure of $15,000 to $50,000 to update the NH Vital Record Information Network. The New Hampshire Municipal Association states that the impact on local revenue and expenditure is indeterminable, as they are unable to determine how many individuals will request this change. However, they believe the number will likely be low.
