STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty One
AN ACT relative to pharmacist administration of vaccines and allowing a licensed
advanced pharmacy technician to administer vaccines.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 1 Pharmacist Administration of Vaccines. Amend RSA 318:16-b to read as follows:
2 318:16-b Pharmacist Administration of Vaccines. A pharmacist [or], pharmacy intern, or
3 licensed advanced pharmacy technician, under the [direct] supervision of an on-site
4 immunizing pharmacist may administer influenza vaccines to the general public and a pharmacist
5 [or], pharmacy intern, or licensed advanced pharmacy technician may administer
6 [pneumococcal and varicella zoster] vaccines, as approved by an immunizing pharmacist and
7 which have been approved by the Centers for Disease Control (CDC), to individuals 18 years
8 of age or older, provided all of the criteria in this section have been met. A pharmacist [or],
9 pharmacy intern, or licensed advanced pharmacy technician under the [direct] supervision of
10 an on-site immunizing pharmacist may administer a COVID-19 vaccine, if available, provided that
11 all applicable criteria in this section have been met. [The pharmacist or pharmacy intern
12 administering a COVID-19 vaccine shall notify the patient's primary care physician.] The
13 pharmacist [and], pharmacy intern, or licensed advanced pharmacy technician shall:
14 I. Hold a current license to practice as a pharmacist, or be registered as a pharmacy intern
15 under RSA 318:15-b in New Hampshire, or be licensed as a licensed advanced pharmacy
16 technician under RSA 318:15-c.
17 II. Possess at least $1,000,000 of professional liability insurance coverage.
18 III. In order to administer [influenza, pneumococcal, and varicella zoster] vaccines, have
19 completed training specific to [the administering] administration of the respective vaccines that
20 includes programs approved by the Accreditation Council for Pharmacy Education (ACPE) or
21 curriculum-based programs from an ACPE-accredited college of pharmacy or state or local health
22 department programs or programs recognized by the board.
23 IV. Provide to the board evidence of compliance with paragraphs I-III.
24 V. Provide notice to the primary care provider, when designated by the patient, of the
25 administration of [the pneumococcal and varicella zoster] vaccines.
26 VI. Record the vaccination in the state vaccine registry and maintain a record of
27 administration of [pneumococcal and varicella zoster] vaccinations for each individual as required by
28 state and federal law.
29 2 Repeal. RSA 318:16-d, relative to additional authority for pharmacist administration of
30 vaccines, is repealed.
