1 THE MEMBERS OF THE ONE HUNDRED EIGHTH LEGISLATURE OF NEBRASKA, FIRST
2 SESSION, RESOLVE THAT:
3 Section 1. At the general election in November 2024, the following
4 proposed amendment to the Constitution of Nebraska shall be submitted to
5 the electors of the State of Nebraska for approval or rejection:
6 To add a new section 31 to Article I:
7 I-31 (1) Every individual has a fundamental right to reproductive
8 freedom, which entails the right to make and effectuate decisions about
9 all matters relating to pregnancy, including, but not limited to,
10 prenatal care, childbirth, postpartum care, contraception, sterilization,
11 abortion care, miscarriage management, and infertility care.
12 (2) The state shall not penalize, prosecute, or otherwise take
13 adverse action against an individual based on the individual's actual,
14 potential, perceived, or alleged pregnancy outcomes, including, but not
15 limited to, miscarriage, stillbirth, or abortion, nor shall the state
16 penalize, prosecute, or otherwise take adverse action against any person
17 for aiding or assisting a pregnant individual in exercising such
18 individual's right to reproductive freedom with such individual's
19 voluntary consent.
20 (3) This section shall be self-executing.
21 Sec. 2. The proposed amendment shall be submitted to the electors
22 in the manner prescribed by the Constitution of Nebraska, Article XVI,
23 section 1, with the following ballot language:

1 A constitutional amendment to protect individuals' right to
2 reproductive freedom and protect persons aiding and assisting pregnant
3 individuals in exercising such right.
