1 A BILL FOR AN ACT relating to the aid to dependent children program; to
2 amend section 43-513, Reissue Revised Statutes of Nebraska; to
3 change requirements related to the standard of need; and to repeal
4 the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 43-513, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 43-513 (1) The standard of need represents the regular recurring
4 monthly amount necessary for basic subsistence and is part of the initial
5 income test in determining eligibility for aid to dependent children
6 benefits using the Budget the Gap Methodology described in subdivision
7 (1)(p) of section 68-1713.
8 (2) Effective July 1, 2024, the standard of need for a single
9 individual shall be one thousand one hundred thirty-two dollars and fifty
10 cents plus three hundred ninety-three dollars for each additional
11 individual in the aid to dependent children unit.
12 (3) The standard of need for aid to dependent children payments
13 shall be adjusted on July 1 of every second year beginning July 1, 2024
14 1997. The adjustment shall be made on the basis of the rate of growth of
15 the Consumer Price Index as determined by the United States Department of
16 Labor, Bureau of Labor Statistics, for the two previous calendar year
17 years. The aid to dependent children payment made shall not be greater
18 than the amount specified by section 43-512.
19 (4) The standard of need is also used to calculate a unit's aid to
20 dependent children benefit amount.
21 Sec. 2. Original section 43-513, Reissue Revised Statutes of
22 Nebraska, is repealed.
