1 A BILL FOR AN ACT relating to the Nebraska Trust Deeds Act; to amend
2 section 76-1007, Reissue Revised Statutes of Nebraska; to change
3 provisions relating to the location of the sale of trust property;
4 to repeal the original section; and to declare an emergency.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 76-1007, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 76-1007 (1) The trustee or the attorney for the trustee shall give
4 written notice of the time and place of sale particularly describing the
5 property to be sold by publication of such notice, at least five times,
6 once a week for five consecutive weeks, the last publication to be at
7 least ten days but not more than thirty days prior to the sale, in some
8 newspaper having a general circulation in each county in which the
9 property to be sold, or some part thereof, is situated.
10 (2) The sale shall be held at the time and place designated in the
11 notice of sale which shall be between the hours of nine a.m. and five
12 p.m. and at (a) the premises, (b) or at the courthouse of the county in
13 which the property to be sold, or some part thereof, is situated, or (c)
14 a public building wherein county offices are located within the county in
15 which the property to be sold, or some part thereof, is situated.
16 (3) The notice of sale shall be sufficient if made in substantially
17 the following form:

19 The following described property will be sold at public auction to
20 the highest bidder at the .......... door of the county courthouse
21 in .............., County of ............, Nebraska, on .........,
22 20.... .
23 (Name of Trustee) .......................................
24 Sec. 2. Original section 76-1007, Reissue Revised Statutes of
25 Nebraska, is repealed.
26 Sec. 3. Since an emergency exists, this act takes effect when
27 passed and approved according to law.
