1 A BILL FOR AN ACT relating to counties; to amend section 23-2802, Reissue
2 Revised Statutes of Nebraska; to change provisions relating to
3 county boards of corrections in certain counties; to harmonize
4 provisions; and to repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 23-2802, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 23-2802 (1) In each county having a population of one hundred fifty
4 thousand or more inhabitants, the county board shall also serve as the
5 county board of corrections. The county board of corrections shall
6 deliberate and take action with the professional advice and counsel of
7 the county sheriff.
8 (2) In and in counties of less than one hundred fifty thousand
9 inhabitants, the county board may choose to serve as the county board of
10 corrections.
11 (3) Any such county board of corrections shall have charge of the
12 county jail and correctional facilities and of all persons by law
13 confined in such jail or correctional facilities. A Such county board of
14 corrections shall comply with any rule prescribed by the Jail Standards
15 Board pursuant to sections 47-101 to 47-104.
16 Sec. 2. Original section 23-2802, Reissue Revised Statutes of
17 Nebraska, is repealed.
