1 A BILL FOR AN ACT relating to labor; to amend section 79-873, Reissue
2 Revised Statutes of Nebraska; to allow public school employees to
3 join or terminate membership in a labor organization as prescribed;
4 to harmonize provisions; to repeal the original section; and to
5 declare an emergency.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Except as otherwise prohibited by a membership contract
2 in effect on the effective date of this act, no labor organization
3 representing public school employees or employer of public school
4 employees shall place any restriction on when a public school employee
5 may join or terminate membership in a labor organization.
6 Sec. 2. Section 79-873, Reissue Revised Statutes of Nebraska, is
7 amended to read:
8 79-873 An authorization for a deduction under section 79-872 shall
9 be in writing, and the form to authorize shall also include a notice to
10 the employee of his or her right to refuse authorization. The
11 authorization shall continue in force until revoked in writing by the
12 employee. The authorization may also authorize the professional or labor
13 organization to certify annually the amount to be deducted from each
14 employee's wages, and, except as otherwise provided in section 1 of this
15 act, such certification shall bind the employee, the school district, and
16 the organization.
17 Sec. 3. Original section 79-873, Reissue Revised Statutes of
18 Nebraska, is repealed.
19 Sec. 4. Since an emergency exists, this act takes effect when
20 passed and approved according to law.
