1 A BILL FOR AN ACT relating to the Game and Parks Commission; to amend
2 section 37-104, Reissue Revised Statutes of Nebraska; to provide for
3 the relocation of commission headquarters as prescribed; and to
4 repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 37-104, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 37-104 (1) Regular meetings of the Game and Parks Commission shall
4 be held quarterly. Special meetings may be held upon call of the
5 chairperson or pursuant to a call signed by three other members, of which
6 the chairperson shall have three days' written notice. No official action
7 shall be taken except at a public meeting at the headquarters of the
8 commission or at a public meeting at a location within the state as
9 determined by a majority of members of the commission. Four members of
10 the commission shall constitute a quorum for the transaction of business.
11 (2) Except as provided in subsection (3) of this section, all All
12 regular meetings held in Lincoln, Nebraska, shall be held in suitable
13 offices to be provided under the authority of Chapter 72, article 14. The
14 Game and Parks Commission is authorized to enter into an agreement with
15 the city of Lincoln providing for the supplying by the city of Lincoln to
16 the State of Nebraska for the commission of a headquarters office
17 building and related buildings and facilities therefor, including the
18 parking of motor vehicles, to be located on real estate which is north of
19 Holdrege Street and east of 33rd Street.
20 (3) The Legislature finds that it is important that state agencies
21 responsible for the protection and regulation of parks, wildlife, and
22 game reserves conduct their official duties in or near proximity to the
23 parks, wildlife, and game reserves such agencies protect and regulate. No
24 later than June 30, 2023, the headquarters for the Game and Parks
25 Commission shall be located in a county with a population of ten thousand
26 or fewer inhabitants. The new headquarters shall be located two hundred
27 miles or more from any city of the metropolitan class or city of the
28 primary class. All regular meetings held shall be held in suitable
29 offices to be provided under the authority of Chapter 72, article 14. The
30 commission is authorized to enter into an agreement with any city or
31 village in a county described in this subsection providing for the

1 supplying by such city or village to the State of Nebraska for the
2 commission of a headquarters office building and related buildings and
3 facilities including parking for motor vehicles. Prior to selecting a new
4 headquarters location and entering into an agreement as authorized in
5 this subsection, the commission shall consider the value of the economic
6 development incentives provided by a qualifying city or village.
7 Sec. 2. Original section 37-104, Reissue Revised Statutes of
8 Nebraska, is repealed.
