1 A BILL FOR AN ACT relating to municipalities; to amend section 86-594,
2 Reissue Revised Statutes of Nebraska; to authorize retail or
3 wholesale broadband services or Internet services by a municipality;
4 to harmonize provisions; to provide a duty for the Revisor of
5 Statutes; and to repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. A municipality may provide broadband services or
2 Internet services on a retail or wholesale basis. For purposes of this
3 section, broadband services and Internet services have the same meaning
4 as in section 86-593.
5 Sec. 2. Section 86-594, Reissue Revised Statutes of Nebraska, is
6 amended to read:
7 86-594 (1) Except as provided in the Educational Service Units Act
8 and sections 79-1319, 81-1120.01 to 81-1120.28, 85-401 to 85-418, 85-1501
9 to 85-1542, and 86-575, and section 1 of this act, an agency or political
10 subdivision of the state that is not a public power supplier shall not
11 provide on a retail or wholesale basis any broadband services, Internet
12 services, telecommunications services, or video services.
13 (2) The provisions of subsection (1) of this section shall not apply
14 to services which an agency or political subdivision of the state was
15 authorized to provide and was providing prior to January 1, 2005.
16 Sec. 3. The Revisor of Statutes shall assign section 1 of this act
17 to Chapter 18.
18 Sec. 4. Original section 86-594, Reissue Revised Statutes of
19 Nebraska, is repealed.
