1 A BILL FOR AN ACT relating to public health; to provide for an enhanced
2 penalty for violations of directed health measures committed by
3 public officials involved in passing such measures.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) Any public official who signs, authorizes, or enacts
2 a directed health measure and violates such measure shall be punished as
3 follows:
4 (a) If a violation of the directed health measure is punishable as a
5 criminal offense, it shall be punished by the imposition of the next
6 higher penalty classification than the penalty classification prescribed
7 for such violation; and
8 (b) If a violation of the directed health measure is punishable by a
9 fine only, the amount of the fine imposed shall be three times the amount
10 otherwise prescribed.
11 (2) For purposes of this section:
12 (a) Directed health measure means a rule, regulation, or ordinance
13 designed to prevent or ameliorate the spread of any contagious or
14 infectious disease; and
15 (b) Public official includes any official of a county, district, or
16 city-county health department as defined in section 71-1626, an official
17 within the Department of Health and Human Services, the Governor, a
18 mayor, a city manager, or any other official who signs, authorizes, or
19 enacts a directed health measure.
