1 A BILL FOR AN ACT relating to schools; to amend section 79-770, Reissue
2 Revised Statutes of Nebraska; to correct references to a federally
3 defined term; and to repeal the original section.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 79-770, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 79-770 At the request of a parent or guardian, a school district
4 shall issue a certificate of attendance to a student who receives special
5 education services under the Special Education Act, who has reached
6 seventeen years of age, and who has not completed his or her
7 individualized education program plan. A school district shall allow a
8 student who receives a certificate of attendance under this section to
9 participate in the high school graduation ceremony of such high school
10 with students receiving high school diplomas. A student may receive only
11 one certificate of attendance and may participate in only one graduation
12 ceremony based on such certificate. The receipt of a certificate of
13 attendance pursuant to this section shall not affect a school district's
14 obligation to continue to provide special education services to a student
15 receiving such certificate.
16 This section does not preclude a student from receiving a high
17 school diploma by meeting the school district's graduation requirements
18 established pursuant to section 79-729 or in his or her individualized
19 education program plan or receiving a diploma of high school equivalency
20 under section 79-730 upon completing the requirements of such section.
21 The school district may allow a student who has previously participated
22 in a graduation ceremony based on a certificate of attendance to
23 participate in an additional graduation ceremony when such student
24 receives a high school diploma.
25 Sec. 2. Original section 79-770, Reissue Revised Statutes of
26 Nebraska, is repealed.
