1 A BILL FOR AN ACT relating to public health; to define terms; and to
2 provide for the treatment of Lyme disease as prescribed.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) If a physician licensed under the Uniform
2 Credentialing Act diagnoses a patient with Lyme disease, the physician
3 may prescribe, administer, or dispense long-term antibiotic therapy for a
4 therapeutic purpose to eliminate infection or control a patient's
5 symptoms if such diagnosis and treatment are documented in the patient's
6 medical record by the prescribing licensed physician.
7 (2) For purposes of this section, long-term antibiotic therapy means
8 the administration of oral, intramuscular, or intravenous antibiotics
9 singly or in combination for periods of time in excess of four weeks.
10 (3) For purposes of this section, Lyme disease means the clinical
11 diagnosis by a licensed physician of the presence in a patient of signs
12 or symptoms compatible with acute infection with Borrelia burgdorferi, or
13 with late state or persistent or choric infection with Borrelia
14 burgdorferi, or with complications which relate to such an infection, or
15 such other strains of borrelia that are recognized by the Centers for
16 Disease Control and Prevention as a cause of Lyme disease. Lyme disease
17 includes an infection that meets the surveillance criteria set forth by
18 the Centers for Disease Control and Prevention and other acute and
19 chronic manifestations of such an infection, as determined by a licensed
20 physician pursuant to a clinical diagnosis that is based on knowledge and
21 which provides supportive data for such clinical diagnosis.
