1 A BILL FOR AN ACT relating to the Nebraska Juvenile Code; to amend
2 section 43-284.02, Reissue Revised Statutes of Nebraska; to change
3 provisions relating to payments to guardians of former wards; and to
4 repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 43-284.02, Reissue Revised Statutes of Nebraska,
2 is amended to read:
3 43-284.02 (1) The Department of Health and Human Services may make
4 payments as needed on behalf of a child who has been a ward of the
5 department after the appointment of a guardian for the child. Such
6 payments to the guardian may include maintenance costs, medical and
7 surgical expenses, and other costs incidental to the care of the child.
8 All such payments shall terminate on or before the child's nineteenth
9 birthday unless the child is eligible for extended guardianship
10 assistance and medical care from the department pursuant to section
11 43-4511. The child under guardianship shall be a child for whom the
12 guardianship would not be possible without the financial aid provided
13 under this section.
14 (2)(a) The department may adjust the amount of such payments upon
15 request of the guardian. The guardian must provide documentation
16 satisfactory to the department supporting the need for an adjustment. The
17 adjustment may be based on a change in expenses for the child or a change
18 in other family circumstances.
19 (b) The department may also adjust such payments when a change in
20 law or rules and regulations indicates the need for an adjustment.
21 (3) The department Department of Health and Human Services shall
22 adopt and promulgate rules and regulations for the administration of this
23 section.
24 Sec. 2. Original section 43-284.02, Reissue Revised Statutes of
25 Nebraska, is repealed.
