1 A BILL FOR AN ACT relating to sanitary and improvement districts; to
2 amend section 31-745, Reissue Revised Statutes of Nebraska; to
3 change hearing and notice requirements as prescribed; and to repeal
4 the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 31-745, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 31-745 (1) Any resolution set for consideration before the board of
4 trustees or the administrator pursuant to section 31-744 shall have a
5 hearing in the county where the district is organized. At such hearing
6 the owners of the property which might become subject to assessment for
7 the contemplated improvement may appear and make objections to the
8 proposed improvement. Following the hearing, except as provided in
9 section 31-746, such resolution may be amended and adopted or adopted as
10 proposed Notice of the time and place, which place shall be in the county
11 where the district is organized, when any such resolution shall be set
12 for consideration before the board of trustees or the administrator,
13 shall be given the same day each week two consecutive weeks in a
14 newspaper of general circulation published in the county where the
15 district was organized, which publication shall contain the entire
16 wording of the resolution and be posted in three conspicuous places in
17 the district. The last publication shall not be less than five days nor
18 more than two weeks prior to the time set for hearing on objections to
19 the adoption of any such resolution, at which hearing the owners of the
20 property which might become subject to assessment for the contemplated
21 improvement may appear and make objections to the proposed improvement.
22 Thereupon the resolution may be amended and adopted or adopted as
23 proposed.
24 (2) Notice of any hearing required under subsection (1) of this
25 section shall:
26 (a) Contain the time and place of such hearing and the entire
27 wording of the resolution that is the subject of the hearing;
28 (b) Be published the same day of the week for two consecutive weeks
29 in a newspaper of general circulation in the county where the district is
30 organized with the last such publication occurring not less than five
31 days nor more than two weeks prior to the time set for such hearing;

1 (c) Be delivered directly by mail or electronic means, without
2 charge, to each resident property owner of the district not less than
3 five days nor more than two weeks prior to the time set for such hearing;
4 and
5 (d) Be posted in three conspicuous places in the district.
6 Sec. 2. Original section 31-745, Reissue Revised Statutes of
7 Nebraska, is repealed.
