1 A BILL FOR AN ACT relating to the Board of Parole; to amend sections
2 83-189 and 83-190, Reissue Revised Statutes of Nebraska; to change
3 membership provisions; and to repeal the original sections.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 83-189, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 83-189 The Board of Parole shall consist of five full-time members
4 to be appointed by the Governor. The members of the board shall be of
5 good character and judicious temperament. The members of the board shall
6 have all the powers and duties of board members commencing on the date of
7 appointment. The appointments shall be subject to confirmation by the
8 Legislature at its next regular session following the appointments. At
9 least one member of the board shall be of an ethnic minority group, at
10 least one member shall be female, and at least one member shall have a
11 professional background in corrections.
12 Beginning with members appointed for terms beginning after January
13 1, 2023, at least one member of the board shall have experience as a
14 professional treating mental illness or substance abuse.
15 The One of the five members of the board shall elect one member to
16 serve a four-year term be designated as chairperson by the Governor. In
17 addition to the chairperson's duties as a member of the board as
18 prescribed in subsection (1) of section 83-192, the chairperson he or she
19 shall supervise the administration and operation of the board and shall
20 carry out the duties prescribed in subsection (2) of such section.
21 Sec. 2. Section 83-190, Reissue Revised Statutes of Nebraska, is
22 amended to read:
23 83-190 The members of the Board of Parole appointed for terms
24 beginning prior to January 1, 2023, shall have terms of office of six
25 years, and the member appointed for terms beginning after January 1,
26 2023, shall have terms of office of eight years and until their
27 successors are appointed. The successors shall be appointed in the same
28 manner as provided for the members first appointed, and a vacancy
29 occurring before expiration of a term of office shall be similarly filled
30 for the unexpired term. A member of the board may not be reappointed for
31 a consecutive term.

1 The members of the board may be removed only for disability, neglect
2 of duty, or malfeasance in office by the Board of Pardons after a
3 hearing. The Board of Pardons shall promptly file in the office of the
4 Secretary of State a complete statement of the charges, its findings and
5 disposition, and a complete record of the proceedings.
6 Sec. 3. Original sections 83-189 and 83-190, Reissue Revised
7 Statutes of Nebraska, are repealed.
