1 A BILL FOR AN ACT relating to the Department of Health and Human
2 Services; to provide for youth rehabilitation and treatment center
3 operations plans.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) The Department of Health and Human Services shall
2 develop a five-year operations plan for the Youth Rehabilitation and
3 Treatment Center-Geneva and the Youth Rehabilitation and Treatment
4 Center-Kearney on or before November 15, 2020.
5 (2) Each operations plan shall be made with input from key
6 stakeholders and shall include, but not be limited to:
7 (a) A description of the population served at each youth
8 rehabilitation and treatment center;
9 (b) An organizational chart of supervisors and operations staff. The
10 operations plan shall not allow for administrative staff to have
11 oversight over more than one youth rehabilitation and treatment center
12 and shall not allow for clinical staff to have responsibility over more
13 than one youth rehabilitation and treatment center;
14 (c) Staff who shall be centralized off-site or managed onsite,
15 including facilities and maintenance staff;
16 (d) A facility plan that considers taxpayer investments already made
17 in the facilities and the community support and acceptance of the
18 juveniles in the community surrounding the youth rehabilitation and
19 treatment center;
20 (e) A description of each rehabilitation program offered at the
21 facility;
22 (f) A description of each mental health treatment plan offered at
23 the facility;
24 (g) A description of reentry and discharge planning;
25 (h) A staffing plan that ensures adequate staffing;
26 (i) An education plan developed in collaboration with the State
27 Department of Education;
28 (j) A capital improvements budget;
29 (k) An operating budget;
30 (l) A disaster recovery plan;
31 (m) A plan to segregate the juveniles by gender on separate

1 campuses;
2 (n) A parenting plan for juveniles placed in a youth rehabilitation
3 and treatment center who are parenting;
4 (o) A statement of the rights of juveniles placed at the facility,
5 including a right to privacy, and the rights of parents or guardians;
6 (p) Quality and outcome measurements for tracking outcomes for
7 juveniles when they are discharged from the youth rehabilitation and
8 treatment center, including an exit survey of such juveniles;
9 (q) Key performance indicators to be included in the annual report
10 required under this section;
11 (r) A requirement for trauma-informed training provided to staff;
12 (s) Methods and procedures for investigations at the youth
13 rehabilitation and treatment center; and
14 (t) A grievance process for juveniles placed at the facility.
15 (3) The department shall submit a report electronically to the Clerk
16 of the Legislature on or before December 15 of each year regarding such
17 operations plans and key performance indicators.
