1 A BILL FOR AN ACT relating to special elections; to amend section 32-405,
2 Reissue Revised Statutes of Nebraska; to change restrictions on
3 special elections held under the Election Act; and to repeal the
4 original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 32-405, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 32-405 Any special election under the Election Act shall be held on
4 the first Tuesday following the second Monday of the selected month
5 unless otherwise specifically provided. No special election shall be held
6 under the Election Act in April, May, June, September, October, November,
7 or December of an even-numbered year unless it is held in conjunction
8 with the statewide primary or general election. A special election for a
9 Class III, IV, or V school district which is located in whole or in part
10 in a county in which a city of the primary or metropolitan class is
11 located may be held in conjunction with the primary or general election
12 for a city of the primary or metropolitan class which is governed by a
13 home rule charter.
14 Sec. 2. Original section 32-405, Reissue Revised Statutes of
15 Nebraska, is repealed.
