1 A BILL FOR AN ACT relating to public health and welfare; to adopt the
2 Population Health Information Act.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. Sections 1 to 4 of this act shall be known and may be
2 cited as the Population Health Information Act.
3 Sec. 2. For purposes of the Population Health Information Act:
4 (1) Department means the Department of Health and Human Services;
5 (2) Designated health information exchange means the statewide
6 health information exchange described in section 71-2455;
7 (3) Health care entity means a health care facility as defined in
8 section 71-413, a home health agency as defined in section 71-417, an
9 urgent care treatment center, a laboratory, a medicaid managed care
10 organization, a federally qualified health center, a health care
11 practitioner facility as defined in section 71-414, a dental facility, a
12 local public health department, a health insurance carrier, or any other
13 organization or entity providing health care services in Nebraska;
14 (4) Health care provider means a person practicing as a health care
15 professional under the Uniform Credentialing Act; and
16 (5) Prescription drug monitoring program means the program created
17 under section 71-2454.
18 Sec. 3. The purpose of the Population Health Information Act is to
19 designate an entity to provide the data infrastructure needed to assist
20 in creating a healthier Nebraska and operating the electronic health
21 records initiative. The designated health information exchange shall:
22 (1) Aggregate clinical information from health care entities needed
23 to support the operation of the medical assistance program under the
24 Medical Assistance Act;
25 (2) Act as the designated entity for purposes of access to and
26 analysis of health data;
27 (3) Collect and analyze data for purposes of informing the
28 Legislature, the department, health care providers, and health care
29 entities as to the cost of, access to, and quality of health care in
30 Nebraska;
31 (4) Act as the primary collector and reporter of public health data

1 for registry submissions, immunization reporting, and syndromic
2 surveillance; and
3 (5) Enable any health care provider or health care entity to access
4 information available within the designated health information exchange
5 to evaluate and monitor care and treatment of a patient in accordance
6 with the privacy and security provisions set forth in the federal Health
7 Insurance Portability and Accountability Act of 1996, Public Law 104-191.
8 Sec. 4. The department shall work collaboratively with the
9 designated health information exchange to access funding through federal
10 programs which shall include, but not be limited to, the Centers for
11 Medicare and Medicaid Services, the Centers for Disease Control and
12 Prevention, and the Health Resources and Services Administration of the
13 United States Department of Health and Human Services, and other federal
14 programs related to health information, technology, population health,
15 and health care delivery system initiatives.
