1 A BILL FOR AN ACT relating to appropriations; to state intent regarding
2 appropriations for mental health services.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. It is the intent of the Legislature to fund rate
2 increases for rates paid to providers of mental health and behavioral
3 health services to provide reimbursement comparable to the rates paid as
4 of January 1, 2020, by the Division of Behavioral Health of the
5 Department of Health and Human Services as provided in this section. The
6 money shall be prioritized for mental health and behavioral health
7 services reimbursed in FY2019-20 at fifteen percent or more below such
8 rates paid by the division. Funding shall be provided for mental health
9 and behavioral health services, including, but not limited to, day
10 rehabilitation services, mental health individual sessions, substance use
11 disorder individual sessions, substance use disorder assessments,
12 therapeutic community services, and psychiatric residential
13 rehabilitation. The money shall be appropriated to the Division of
14 Behavioral Health of the Department of Health and Human Services, the
15 medical assistance program, and the Office of Probation Administration.
16 It is the intent of the Legislature that funds appropriated for mental
17 health and behavioral health rate increases be utilized only for mental
18 health and behavioral health rate increases.
